This is a legal document between the client “the renter” and “Chummy Bunch, LLC” which affects your legal rights, so please read carefully.

The renter desires to rent from Chummy Bunch, LLC, its equipment and services to be used by the renter, his/her guests, including minors, affiliates, and other individuals while in renter's possession. Renter understands that use of this soft play and/or bounce house rental equipment, by its nature, can cause injury or harm to client, his/her guests, including minors, affiliates, or other individuals.

I hereby freely, voluntarily, and without duress execute this release under the following terms:

1. Waiver and Release: I hereby understand and acknowledge that this release discharges Chummy Bunch, LLC., from any liability or claim that the renter may have against Chummy Bunch, LLC., AND AFFILIATES with respect to any bodily injury, personal injury, illness, death, or property damage that may result from the renters use and possession of Chummy Bunch, LLC equipment. Renter does hereby release and forever discharges and hold harmless Chummy Bunch, LLC., and its successors from any and all liability claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from renters possession and use of Chummy Bunch’s  equipment.
2. Indemnification: I hereby agree to release, waive, and forever discharge and hold harmless Chummy Bunch, LLC and its members, agents, affiliates, volunteers, insurer, or other representatives from any and all liability, claims, demands, attorney fees, costs, expenses and compensation arising out of or in any way related to any injury or other damage that may result to self (renter) or guests, including minors, affiliates, and other persons for whom I am otherwise responsible for while participating in or present at event, WHETHER ARISING FROM THE NEGLIGENCE OR RELEASES OF OTHERWISE.
3. Insurance: I hereby understand and acknowledge that insurance for liability, health, and medical or disability coverage in any way related to the rental of equipment under this agreement is the sole responsibility of the renter. I understand that I, my guests, including minors, affiliates, and all other persons are strongly encouraged to have a medical, physical exam and purchase health insurance before use of equipment.
4. Assumption of Risk: I hereby understand and acknowledge that participation in the activities which I am or/and guests, including minors, affiliates, and other individuals about to voluntarily engage in as a participant involves risk and may result in various types of injury including, but not limited to, sickness, bodily injury, death, emotional injury, personal injury, property damage and financial damage. I voluntarily assume all such risks using rental equipment, including risk known and unknown, of injuries, however caused, even if caused in whole or part by the action, inaction, or negligence of Chummy Bunch, LLC or its members, agents, affiliates, volunteers, or other persons (collectively, “releases”) to the fullest extent of the law.
5. Warranties and Representations: I hereby understand and acknowledge Chummy Bunch LLC makes no representations or warranties as to the condition or operation of the rental equipment, which I am or/and guests, including minors, affiliates, and other individuals about to voluntarily engage in as a participant. The rental equipment is provided, and I (renter) accept the rental equipment on an “As Is” basis and with all faults and defects. Lessor hereby disclaims any and all warranties, express or implied, with respect to the rental equipment, including but not limited to warranties of merchantability or fitness for a particular purpose.

Safety Rules and Procedures

• All children must be supervised by an adult (18 years +) at all times while in play area.
• Soft Play is suitable for ages up to 5 years old and MUST NOT be used by older children, adults, or infants not able to sit on their own.
• Absolutely NO PETS allowed in or around the play area.
• NO shoes, sneakers, high heels, flip flops or sandals allowed inside or on equipment, including mats.
• NO food, drinks, chewing gum, candy, of any kind, etc.
• NO FACE PAINT, party poppers, water bubbles, confetti , colored streamers, slime, paint, markers, silly string, glitter, or any sticky items that may cause permanent damage to equipment to be used on the play area.
• NO flips of any kind, pushing, shoving, wrestling, or horseplay allowed.
• NO equipment or accessories, including balls shall be dismantled or moved outside of the play area.
• NO climbing and playing on the roof of bounce houses.
• NO climbing, pulling, slamming or sitting on the safety fences.
• NO BBQ’s, firepits or heat emitted items permitted within 50ft of equipment.
• NO Smoking in or around equipment
• NO more than the recommended number of people and maximum weight allowed in the play area and/or bounce house at one time. Maximum capacity of participants and weight requirements is listed in the product description. (renter is to ensure that the area is not overcrowded, and the number of participants is limited according to age and size).
• If bad weather suddenly occurs, have all participants safely exit the play area.
• Report all incidents and/or damages immediately to Chummy Bunch.

I hereby understand and acknowledge:

1. I acknowledge responsibility to adhere to the rules and safety procedures mentioned above by Chummy Bunch, LLC., in order to protect the equipment and provide a safe environment for me, my guests and any other persons who will have access to Chummy Bunch’s equipment while in my possession.
2. I acknowledge sole responsibility of informing my guests and any other persons in attendance of the Chummy Bunch safety rules and policies in this contract agreement.
3. I agree to not loan, or sublet Chummy Bunch equipment.
4. I agree to pay the full replacement or repair cost, including labor, if the soft play equipment is lost, stolen, or damaged beyond repair.
5. I acknowledge responsibility to ensure that all possible safety precautions are taken to avoid any kind of injury to the participants and/or damage to the equipment.
6. I understand that sprinklers must be turned off if Chummy Bunch equipment is to be set up in grass.
7. I understand soft play equipment is for ages 5 years old and below.
8. I understand it is prohibited to move equipment out of the original set up location (moving equipment may cause injury and damage to equipment).
9. I understand no face paint, markers, pens, slime, silly string, food, drinks, pets, sharp objects, shoes, heels, etc., are allowed in or around play areas and rental equipment
10. I understand that an alternative inside location is required in case of inclement weather. If an alternative location is not available, rental will be canceled and can be rescheduled within a year.
11. I understand that a minimum $200 deposit is required at the time of booking and remaining balance is due before or during the set up hour before your event. Booking confirmation is not secured until initial payment is received
12. I understand that balls should be kept within the play area and not the whole location. A $50 fee will be paid if Chummy Bunch has to pick up balls outside the designated play area.
13. I understand that 6pm is the latest time for pick up. Anytime after 7pm will be charged an overnight fee of $100 or if needed to be picked up the same day will be charged an extra $50/hour for 8pm and 9pm, $60/hour for 10pm and 11pm.
14. I understand that the renter will be responsible for Chummy Bunch equipment if the renter requests to keep the equipment overnight and to keep it in a secure and safe location.

Public Park or Rented Venue

1. I understand that Chummy Bunch equipment shall not be left unattended at a public park or any rented venue/space.
2. I understand that Chummy Bunch would need at least an hour for pick up. It is the renter’s responsibility to coordinate a pick up time that is within the time frame of their rental. Chummy Bunch will not be responsible for any additional fees that may incur as a result pick up delays.
3. I understand that it is the renter’s responsibility to make sure there are working electrical outlets to be used if a bounce house is rented.
4. I understand that if no electrical outlet is available, I have the responsibility to provide a minimum of 35000 watts generator and to operate it if I’m not renting from Chummy Bunch, LLC. 

I further acknowledge the risks involved in Chummy Bunch soft play areas and bounce houses, assume all liability, including but not limited to any CHOKING HAZARDS, FALLING, TRIPPING, ETC., while in use. I understand that I and my guests are participating voluntarily, and that all risks have been made clear to me. I further acknowledge that I do not have any conditions that will increase my likelihood of experiencing injuries while participating in this activity.

I CONFIRM THAT I AM AT LEAST (18) YEARS OF AGE AND FULLY COMPETENT TO GIVE MY CONSENT. I ACKNOWLEDGE THAT I HAVE READ ALL THE FOREGOING RENTAL AGREEMENT AND LIABILITY WAIVER CONSTITUTES THE ENTIRE AGREEMENT OF THE PARTIES HERETO AND SUPERSEDES ALL PRIOR REPRESENTATIONS, UNDERSTANDINGS, UNDERTAKINGS OR AGREEMENTS (WHETHER ORAL OR WRITTEN AND WHETHER EXPRESSED OR IMPLIED) OF THE PARTIES WITH RESPECT TO THE SUBJECT MATTER HEREOF, I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY MY CHECKING THIS WAIVER AND AGREEING TO THESE TERMS, AND I SIGN THIS AGREEMENT FOR MYSELF AND ON BEHALF OF MY GUESTS, INCLUDING MINOR(S), AFFILIATES AND OTHER INDIVIDUALS, AND AGREE TO THESE TERMS FREELY AND VOLUNTARILY AND WITHOUT INDUCEMENT.
